Who may oppose a preliminarily published China trademark?

Under Article 33 of China’s 2019 Trademark Law, which is in force as of 2 November 2026, a prior rights holder or interested party may oppose on the specified prior-rights grounds; anyone may oppose on the specified public-interest or absolute grounds. Identify the precise ground and the official publication record before deciding who may file.

Confirm the application stage

A mark that has been filed, preliminarily published or registered can call for different actions. Obtain the official application number and publication record before labeling a response an “opposition.” The currently applicable Trademark Law text sets out the opposition framework; a general site article cannot determine standing for a specific person or organization.

Connect standing to the ground

Do not assume every observer can rely on every legal ground. A professional review should identify the provision invoked, the opposing party's relationship to the mark or prior right, and the evidence that supports that relationship. The right holder, an authorized representative and another interested party may have different documents to prepare. The CNIPA online opposition and response guide provides operational context for filing and receiving documents.

Prepare a decision brief

  1. Record the official mark number, applicant, goods or services and publication record.
  2. Identify the earlier mark or other asserted ground and who owns the evidence.
  3. Preserve dated records of use, transactions and communications where relevant.
  4. Ask a China professional to calculate the actual response deadline from the official record and notice.

Article 33 of the 2019 law currently in force sets a three-month opposition period from preliminary publication. Article 36 of the 2026 revised law sets two months, but that law takes effect on 1 January 2027. A pending matter or publication crossing that date requires the official record and any final transitional measure to be checked. Standing still depends on the specific ground; this guide is not a deadline calculation for an individual case.

Discuss a specific matter

Prepare a non-confidential summary of the applicant, proposed mark, goods or services, official documents and dates. Use the contact page for a first brief. Do not send confidential case files through a public page before the intake channel is agreed.
