Direct answer
A China trademark watch should regularly compare relevant official publications against the brand’s actual marks and goods or services, then escalate plausible conflicts to a responsible professional. A watch is a triage process, not a guaranteed detection or legal opinion.
Define the watch list
List the registered and pending word marks, Chinese names, logos and relevant variations that the owner truly uses. Define the goods or services and the business markets that matter. A watch with only an English company name may miss a Chinese name; an indiscriminate watch may generate so many alerts that nobody reviews them. The scope should be recorded and changed when the portfolio changes.
Use the official publication record
CNIPA’s public-service guide describes the official gazette query, including searches by mark name, applicant, application or registration number and gazette issue. Record the official URL, issue, publication date, candidate mark, applicant and goods. A vendor alert is a lead to verify against that source. Do not label every similar spelling as infringement or an opposition-worthy application.
Escalate within the right period
When a candidate is preliminarily published, the office record and governing law determine whether an opposition is available and by when. The 2019 law currently specifies three months; the enacted 2026 law changes the period to two months when effective in 2027. The watcher should flag the issue immediately, but the professional must calculate the case deadline and assess legal grounds and standing.
Questions to put in a case brief
- Which mark versions and classes are within the watch?
- Where is the official gazette page for an alert?
- Who decides whether a similarity merits professional review?
- Who owns deadline calculation and any opposition instruction?
Legal timing and limits
On 2 November 2026, Article 33 of the 2019 amended Trademark Law gives a three-month opposition period from preliminary publication. Article 36 of the 2026 revised Trademark Law states two months, but that revision does not take effect until 1 January 2027. The transitional treatment of a particular publication or matter must be checked against final implementation rules and the official record; do not apply the two-month text before it is effective.

Exact procedural deadlines, eligibility, fees and available remedies must be checked against the actual notice, the current official instructions and the facts of the matter. A filing or registration outcome is never guaranteed.
