Direct answer
The 2026 revision expressly includes trademark use through the internet and other information networks, but the provision starts on 1 January 2027 and still requires a matter-specific use analysis.
What the enacted text says
Article 2 of the 2026 revised Trademark Law describes a trademark as a sign distinguishing the source of goods or services and says use includes acts carried out through the internet and other information networks. The law was adopted on 26 June 2026 and is scheduled to take effect on 1 January 2027 under Article 87. This is an express future-law formulation; it should not be quoted as if it replaced all current analysis in 2026.
The 2019-amended law, Article 48, already describes use on goods, packaging, transaction documents, advertising, exhibitions and other commercial activities to identify source. Online product listings or advertising can be relevant facts under the current framework, but an online appearance is not automatically sufficient to establish use of the registered mark for every designated good or service. The question remains what sign appeared, how it was used, by whom, when and in connection with which products.
Organize digital records so they can be reviewed
Keep original page URLs, dated captures, platform order records, product pages, invoices and proof that the seller or distributor was authorized. Link each record to the registration number and approved goods or services. Avoid relying on a screenshot that has no date, no buyer-facing context or a logo different from the registered sign. If content disappears, preserve the underlying export or archive promptly and lawfully.
Do not overread the change
The express reference to internet and information-network use does not mean that every social post protects every class, or that online use automatically defeats a non-use cancellation request. CNIPA’s summary explains the revision at policy level; case-specific evidentiary value still needs professional review. Check final implementing rules and the date relevant to the specific matter before changing a filing or response plan. ## Questions to resolve before action
- What sign appears online and who controls the account?
- What goods or services does the page actually offer?
- Can the record be dated and linked to a transaction?
- Is the matter governed by current or future law?
