Direct answer

Under the currently applicable 2019 Trademark Law, a China trademark registration lasts ten years from registration and can be renewed in the twelve months before expiry. A six-month grace period may follow. A specific portfolio should be docketed from its official register, not a generic anniversary estimate.

Start with the right date and owner

Article 39 of the 2019 law sets the ten-year term from the registration date. Article 40 sets the renewal window and grace period. CNIPA’s public-service guide describes renewal by the registrant, a transferee or a successor in the relevant circumstances. First obtain the registration record, exact expiry date, current owner name and any change or transfer history. A deadline diary based on the filing date can be wrong.

Prepare the renewal instruction

The official guide lists a renewal application and identity documents; agency instruction and Chinese translation may also be needed depending on the applicant’s situation. Review the registered mark and goods or services against the client’s current portfolio and ensure the person giving instructions is authorized. Paying a professional service invoice is not proof that CNIPA received the renewal; keep submission and office receipts.

Check the 2027 transition

The enacted 2026 law’s Articles 43–44 also state a ten-year term, a twelve-month pre-expiry renewal period and a possible six-month grace period, with commencement on 1 January 2027. That comparison does not replace current fee and form checks. CNIPA may change operational instructions, so a renewal filed later should use the official materials current on its filing date. Confirm the issued renewal record and next expiry after completion.

Questions to put in a case brief

  1. What registration and expiry dates appear in the official record?
  2. Is the applicant still the recorded owner?
  3. Which form, identity and translation documents currently apply?
  4. Who holds proof of filing, payment and the resulting renewal record?

The 2019 amended Trademark Law is the applicable law on this source-check date. The 2026 revised Trademark Law was enacted in June 2026 and is scheduled to take effect on 1 January 2027. A matter crossing that date needs the governing text and any final implementing measures checked again; this guide does not apply the future law early.

Exact procedural deadlines, eligibility, fees and available remedies must be checked against the actual notice, the current official instructions and the facts of the matter. A filing or registration outcome is never guaranteed.
